The War Prerogative and Constitutional Change

A few days after Gordon Brown became Prime Minister in July 2007, the Government heralded an era of change by publishing a Green Paper, The Governance of Britain. The Green Paper intended to initiate extensive constitutional reform by fostering debate or, as it put it, providing ‘the first step in
a national conversation’. This is hardly a first step, as prerogative powers have
been a source of contention since the seventeenth century.
