Soliders and Courts and the Spectre of Exceptionalism

March has seen two significant rulings in the British courts about events in Iraq. The legal issues in each case are very different and it is not the purpose of this note to discuss the process or findings. But there is an important common issue to both. Should service personnel be entitled to some protection from the consequences of the inappropriate or illconsidered use of violence when they act in the very difficult circumstances of military operations?
